DESCRIPTION:The recent case law by the European Court of Justice (ECJ) con
 cerning the right to take collective action\, posted workers and social cl
 auses in public procurement may promote a 'race to the bottom' in the Euro
 pean Union. The presentation will assess the nature of the challenges and 
 the scope for changes in the national labour market systems in the afterma
 th of the ECJ's judgments. While the latter are expected to have a constra
 ining effect on industrial action and collective standard-setting\, they a
 lso open up room for national re-regulation concerning wage levels and ter
 ms and conditions of employment
