DESCRIPTION:In this presentation\, I ask what we can learn about law’s t
reatment of ‘the home’ by considering the position of migrant domestic
workers. I argue that migrant domestic workers experience a situation of
homelessness: their dwelling place is their workplace\, and their workpla
ce is simultaneously someone else’s home. They do not enjoy the protect
ions and freedoms we associate with the home. While they are housed in fa
ct\, their situation is one of legal homelessness. An examination of the
homelessness of migrant domestic workers can shed light on the way the hom
e is conceived of and protected by the legal system\, and importantly\, wh
ose interests these legal protections serve\, or conversely\, ignore.
