This presentation will discuss the access of small island developing states’ (SIDS) to high seas fisheries. SIDS are increasingly involved in high seas fisheries but are often not members of high seas regional fisheries management organisations. The presentation will discuss general and special access to high seas fisheries and then examine recent state practice in two regional fisheries management organisations: the Commission for the Conservation of Antarctic Marine Living Resources and the North East Atlantic Fisheries Commission. An examination of recent state practice in these two regional fisheries management organisations will show that member states are applying the law selectively to various fishing nations and more strictly to SIDS thus in effect restricting SIDS ’ access to high seas fisheries.
