This presentation will explore the legal scope for using both the Convention on the Conservation of Antarctic Marine Living Resources (CCAMLR) and the Madrid Protocol to the Antarctic Treaty for the purpose of cetacean conservation in the Southern Ocean. It will focus on the wording of these two treaties, including their provisions on the relationship between each treaty and the International Convention for the Regulation of Whaling. It will look at which provisions of the two treaties may be particularly relevant to cetacean conservation. The presentation will also summarise the results of a survey of practice under the two treaties, in order to illustrate how they are currently engaging with cetacean issues in the Southern Ocean.
