Abstract
The Grand Chamber of the Court of Justice of the EU will soon determine whether the EU Data Retention Directive complies with the requirements of the EU Charter of Fundamental Rights. Under the Directive, private communication service providers must retain the communications data of its customers for up to two years for law enforcement purposes. This presentation discusses the implications of the main recommendations that the Advocate General has submitted to the Court before it decides the fate of an EU law that has raised human rights concerns within the EU institutions and in national courts across the EU since its inception.
